Mines are required by law in South Africa to set aside funds so that at the end of the mine's life the ground where the mine was can be returned as far as reasonably possible to its original natural state. The Mineral and Petroleum Resource Act (28 of 2002) in section 38 requires that the land be returned to its natural condition as far as is possible. It also says that it is the responsibility of the person holding the mining right that is responsible for any damage to the site, pollution or ecological degradation. Mine rehabilitation in South Africa has not been properly managed over the past 140 years that mining has been conducted, with the result that there are many sites which have not been properly rehabilitated.
