The Minerals and Petroleum Resources Development Act (MPRDA - 28 of 2002) makes the state the custodian of mineral rights in South Africa. Anyone who wishes to exploit those minerals (including those who already owned rights prior to the Act) must obtain a right to do so from the Minister of Mineral Resources. These rights must be registered with the Minerals and Petroleum Titles Registration Office. Once the right has been granted the holder is required to report back on the progress of their prospecting. A right entitles the holder the exclusive right to prospect for specified minerals over a specified area of land. That prospecting right can then be converted into a mining right.
